Most people are now aware that if you are involved in an accident was not your fault, you may be entitled to compensation.  In most cases this means compensation for injury, and it could mean loss of earnings or payment for out of pocket expenses, like travelling costs and replacing or repairing damaged items. 


If you have been involved in a car accident your claim might include repair costs, replacement car hire costs, and potentially a claim for the reduction in the value of your vehicle (called diminution).

What You Are Entitled To

If you have been involved in an accident that was not your fault, you are entitled to be put back in the same position you were in before the accident.  For example you are entitled to recover repair costs, hire costs, and your loss of earnings. 


Personal injury is a little bit different, because no one can take away the pain and suffering you experienced.  A settlement for injury is intended to compensate you for that pain and suffering.  You would also be entitled to recover the costs of necessary and reasonable rehabilitation.

What You Are Not Entitled To

Your losses have to be reasonable and they must have been caused by the negligent party.
